Questions to ask when you receive a traffic ticket...

01   How many points do I have on my driving abstract?
02   What is a civil penalty?
03   Do I need to go to court to plead my case?

Traffic

We all get them.  We all wish we had not, the dreaded traffic ticket.   They are given for speeding, running a red light, not having a seat belt on, talking on the cell phone or a number of violations of the vehicle and traffic law. They are inconvenient and time consuming for the average person.  They can also be very expensive and costly if you are not aware of the consequences of pleading guilty to a moving violation.

The New York State Department of Motor Vehicles (NYS DMV) has devised a point system which evaluates your driving record.  If you have 11 or more points in 18 months or if you have a combination of three speeding convictions and/or misdemeanors in 19 months DMV can suspend your driving privileges.  Driving is a privilege in New York State not a right.

In addition to this risk you may have to pay a civil penalty to the NYS DMV for having more than six points on your driving abstract.  For every point greater than six you face a higher penalty.  The civil penalty may be paid in a lump sum or over the course of three years. If you do not pay the civil penalty your license will be suspended.

Our firm goes to all of the area town and justice courts.  We can often minimize your inconvenience by taking care of the ticket through the mail or by having you execute a waiver of appearance which authorizes the firm to enter into a plea on your behalf.
